Domestic Partnerships
Texas does not currently recognize same-sex marriages, and of the law is unclear as to whether out-of-state same-sex marriages should be recognized under Texas law, particularly with regard to permitting a divorce in Texas for couples married elsewhere. However, same-sex couples, within certain boundaries, can enter into a contractual relationship to define the certain rights and responsibilities of each partner in the event of the demise of the relationship. For example, if partners intend to buy a house or another major asset, the agreement can address how much each partner will own of the asset.
Custody
When one parent is biological and the other is not, it is crucial to create legal recognition of both parents' rights. The best way to accomplish this is by having the non-biological parent officially adopt the child. Then, in the event of dissolution of the relationship, both parents will have access to their children the same way other divorced parents do. Parental agreement will be required for the adoption.
