Eligibility

To be eligible for spousal maintenance the marriage in question has to have lasted at least 10 years, or the spouse seeking maintenance must be able to show that their spouse was convicted or received deferred adjudication for a criminal act of domestic violence within two years prior to the divorce.

Even if those eligibility requirements are met, there is no guarantee that spousal maintenance will be granted, due to other factors connected to the other spouse's ability to pay. A number of other factors will be examined, including income, assets, disability of a spouse or disability of a child. The length of a spousal maintenance agreement will be left to the discretion of a judge, often lasting longer when a claim is based on domestic violence or disability.
